LAS VEGAS RESIDENT SENTENCED TO TWO YEARS IN PRISON FOR CRIMINAL COPYRIGHT INFRINGEMENT

Sold Counterfeit Copies of Adobe Software on PriceGrabber.com

SAN JOSE, Calif. – Roosevelt Anderson Jr. was sentenced yesterday to two years in prison and ordered to pay Adobe Systems Incorporated $247,144 in restitution for criminal copyright infringement, United States Attorney Melinda Haag announced.

Anderson was convicted on Feb. 10, 2012, by a jury after a three day trial.  During the trial, evidence showed that Anderson manufactured exact digital copies of Adobe Photoshop Creative Suite 3 and Adobe Photoshop Creative Suite Extended, and advertised them for sale on the Internet website “PriceGrabber.com.”  He also maintained a website, “Anderson9000.com,” where he advertised and sold unauthorized copies of Adobe software.  The evidence showed that Anderson distributed the counterfeit software to purchasers through the United States Postal Service.  The evidence also demonstrated that from approximately Feb. 6, 2008, through Feb. 5, 2009, Anderson sold more than 300 copies of Adobe Photoshop Creative Suite 3 and Adobe Creative Suite Extended, and made more than $70,000.

Anderson, 53, was charged on Jan. 31, 2012, in a superseding information with one count of criminal copyright infringement, in violation of 17 U.S.C. § 506(a)(1)(A) and 18 U.S.C. § 2319(b)(1).

The sentence was handed down by U.S. District Court Judge Edward J. Davila following a jury trial. Judge Davila also sentenced the defendant to a three-year period of supervised release.  The defendant is scheduled to begin serving the sentence on Aug. 30, 2012.

Susan Knight and Michelle J. Kane are the Assistant United States Attorneys who prosecuted the case with the assistance of legal tech Elise Etter and paralegal Lakisha Holliman.  The prosecution is the result of a two-year investigation by the United States Postal Inspection Service.
