One more vote for the David Simons implementation, and leave an option in the preferences to always render audio if the preset has audio checked, for those who have a workflow that might always require a audio track, like Chris Zwar mentioned with relinking in FCP.
I would also support Rolands improvement to the render settings UI.

I like your idea David Simons. We tend to leave audio on all the time whether or not we have it in there. I've been burned by forgetting to render audio when needed but never from having an empty audio track or unneeded tracks. A preference would be nice to control the behavior, but I like the option to not render audio if there is none present. That way I can keep my audio turned on in the output module for the times when I need it.
that would be good with me... more often than not I forget to enable audio for the times I should output it

So, if AE treated an output module with the audio checkbox ON as meaning “output audio if the comp has audio” instead of the current “output audio even if the comp doesn’t have audio”, would that cause trouble for anyone? Presumably that change would fix the above problems, if we also defaulted the audio checkbox ON in the shipping presets.
