I have also been annoyed of this behaviour of AE, but i don't have the problem always and haven't been able to isolate what exactly casues AE to sometimes pick the layer and sometimes the mask. I have an idea that it has something to do with the size of the mask or when the layer is scaled, but i can't reproduce it right now.
