Now that After Effects CC (12.2) has been out for a little while with a fix for this...

Ok, thank you all for the quick help.
In the long term, it would be great to have something like:
- by default new/duplicated layers get a unique name
- if you manually rename them to the original name, a confirm message (with an "don't show this again") informs you about what side effects this will have.

thats new in 12.1 i believe.
i find it a big pain in my workflow as well and i dont believe there is a way to disable it
12.1 added "copy with property links" so now when use that feature it makes sure that there arent two layers with the same name

Why is this and is there any way to avoid this behavior? With CS6 it works fine.
I did some scripts for a client that need some layers have the same name.
