The x264 encoder is indeed open source, but that doesn't mean you can do whatever you want with it.
It is licensed under the GPL, so it can freely be used by other GPL software, i.e. nothing commercial. You can also pay to license it for use in a commercial program.
But that is separate from the H.264 patent licensing, which applies regardless of how you encode your video. MPEG LA says they will not charge for anyone posting free H.264 internet videos, but every other application is fair game.
