Thank you all for sharing your opinions and experiences. Our head of Operation rolled out a new intellectual property policy to our producers and sales team, based in part on the information I gleaned from this thread. Thnx!

 

Mainly, producers and sales people didn’t have clearly spelled out best practices. Now it is included in the SOW (scope of work).

 

We now have a set fee for the service of gathering, removing copy-protected elements, and delivering the files, which can actually take up to 4-8 hours on large projects. We also charge for the IP. Of course, the IP is open to negotiation, particularly with large clients, but the default is not “just give it away” anymore. We do provide master mix downs and raw footage(both animated and live action), but not the source projects.  

 

After some investigation, we discovered clients were never using the files, and were merely asking pro forma - adding a lot of overhead.

I know this has been discussed many times before, but increasingly clients expect/request all files from projects - including Illustrator, photoshop, stock footage and music, AfterFX, and 3ds MAX files.

 

Is this a trend? It has been happening also with clients that we are the agency of record with. I am uncomfortable giving away intellectual property for free and having some freelancer undercutting us using our files!
